You just watched Silicon Valley didn’t you...
If you create it with Deloitte tools (ie laptop), yes
@K1 - what if you were on your way to work from home when you got the idea?
It depends on where you first thought of the idea. Were you at home or at work when the idea occurred to you.
What does your employment agreement say?
I don’t disagree that it’s ridiculous. Yet the contract provision is there so you and potentially your attorneys have to deal with it.
If the idea or side business is successful enough, why wouldn’t the employer assert ownership? It would probably settle out of court but could make them some easy, and potentially substantial, money. It only needs to work once to justify the existing of the clause in the employment contract.
Pretty much anything else gets owned by the firm
@acccenture 1 - no but I have to watch it. There are always ideas floating in my head but I can’t leave firm - gotta pay those pesky mortgage and other bills
It’s all depends, if this is something you published as part of your work at Deloitte , and was deployed internally or at clients. If it’s completely unrelated , it should be yours
Made on Deloitte laptop, it’s theirs. This is a policy I find infuriating.
It doesn’t seem that unreasonable that the employer who owns and provides a laptop would assert ownership of data on it. If you want to avoid that risk, do it on your own hardware. You could always get fired or laid off suddenly and not be allowed to remove your personal data from work-owned hardware.
As to the creation of intellectual property while employed by someone else, wherever it is stored, you need to read your contract and I usually suggest talking to IP attorneys for maximum protection.
Just copy the code and reproduce on your own computer? I'm a strategy guy though so I should probably stfu.
Yes. Your work agreement would have details.
Most Big 4 work agreements say they own your IP while you’re an employee. Did you negotiate something different when you joined?
PWC1 that’s ridiculous. They don’t own everything you do/think. As long as this idea is unrelated to your current line of work. Is built independently on your hardware and not on Deloitte time, they won’t really have much of a chance. I know many people who have launched start ups from Deloitte without issues
Pwc1 and d7 - you are right. I dug up my agreemnt. It defines personal creations as 1) it is conceived, developed and created by me on my own time without using Deloitte property or personnel(during work hours), facilities, CI or Works of a Deloitte entity, 2) it is unrelated to the actual or reasonably anticipated business or research and development of a Deloitte entity and 3) it does not result from any work performed by me and the personnel(during work hours) for a Deloitte entity
OP. Random question. I’ve been with the firm a decade so I can’t even remember that agreement. Was it sent to your personal email before you joined?
It was part of the email that contained offer letter financials and employment agreement
And Yes - sent to my personal email
D7, it's in an APR too
