Not usually in my experience. LoL/indemnity is a commercial point although they cover risks like privacy.
I’m local privacy officer for the US and Canada and most of these things are negotiated by the commercial contracts team and only escalated to me as needed.

If there’s special indemnity or LoL carve outs, etc for privacy related items, we loop in our Privacy team. We have some pocket authority, and only escalate if the asks deviate
We'll sometimes ask privacy for their assessment of the risk, particularly if something very non-standard, but ultimately the negotiation falls to commercial counsel.

For my group it’s a commercial concern but we are supposed to escalate to more senior commercial if something is out of the norm
