Almost every company has a Non-Compete. The thing is, they are not really enforceable. Many states already have laws the strictly limit the scope of non-compete agreements (usually limited to overtly damaging acts, like stealing code or customers). And, even if your state doesn't have such laws, it is rare for companies to actually enforce them. Also, frankly, there are some fairly simple ways to avoid your old company finding out.
I only saw one case where they tried to enforce a non-compete on 'rank and file employees. A group left the company and started their own competing company. The CEO was personally butt-hurt and so took them to court... and lost.
