Yup, I’ve won plenty I shouldn’t have and lost a few dunkers. My best was citing to the entire NY Partnership Law generally… summary judgment granted. With motion practice, you can’t win if you don’t play!

Java Microservices Architect with 40 LPA Fixed (12 YOE) at Nagarro. Joined 8 months back. Got an offer from Publicis Sapient of 55LPA (50 Fixed, 5 Variable). I have asked for 60, but that’s out of their budget. I’m thinking of accepting the offer only if 55 is fixed without any variable. What do tou think guys? Is it worth a switch? Advice: my firm incentivized associates to get licensed in fed courts - 4 fed courts for a 5k raise. They also covered the admission fee. I just accepted an offer with another firm and will be putting in my 2 weeks notice tomorrow. I am a personal injury attorney making 79k with ability to keep 40% of anything I settle, bonuses for originating work for the firm. I work at a small firm with not that many workable templates so I usually have to do everything from scratch like drafting motions, pleadings, and researching all potential counts every time. Do bigger firms have better and more templates that allow you to have to do less research?

It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.

There’s been some turnover over the last six months at my firm, and I have taken over more files. When drafting a brief or other submissions for court or arbitration, do you use words such as clearly, erroneously, etc. to emphasize certain points? Our managing partner says that we should, but all of the writing guides for litigators that I've read repeats the mantra "show, don't tell" and explain that most judges dread such words.

I know that the politically correct thing to do here is to do whatever the managing partner wants me to do, but I just wanted to ask for other ppl's opinion.

I work in a firm that is known for litigation defense. I’ve been developing my own plaintiffs practice as well. I am able to pay the bills with my hourly defense work, which gives me time to focus on a handful of high value PI case a year on contingency. I was recently negotiating a case and was told part of the reason the claims rep/OC was jerking me around was because they didn’t see me as a plaintiffs attorney. Is there any way to change this perception or does it just come over time?

Is there such place as non toxic ID firm? Or does any of ID attys like what they do? I moved from general practice to an ID firm six months ago. Biggest mistake of my life. I am trying hard not to just quit and walk away as I’m battling head cold but still have to bill bill bill and get criticized for not billing right and etc and cases being piled up - while everyone is looking forward to the long weekend.
