Just email it by 8 am tomorrow morning. Its nothing major if it is an agreed order.
Is this fed? Did you meet and confer? I’m assuming you are the Plaintiff at least lololol. Honestly just tell the judge in the hearing it was a mistake. Too late now. Mistake, inadvertence is a thing.
If it’s possible I would just email it to the clerk tonight (obviously CC-ing everyone), and advise them of the missed filing, along with an assurance that it will be filed first thing in the morning. That way they have it available to them during the hearing. Of course, if this is a case in federal court you might still be within the filing deadline depending on your time zone. Either way, assuming it is an agreed order especially, I don’t think this is a huge deal.
Agree it’s not a huge deal. Worst case scenario the judge scolds you a bit and you just respond with something along the lines of “understood your honor, I apologize for the oversight. We’ll make sure to file in the future.” Everyone makes mistakes and you’ll look back and realize this isn’t one to lose sleep over.
Current fed law clerk here: just file it then email a copy to the chambers email acknowledging that it’s a joint plan and that you just wanted to flag it for the court ahead of the conference as a courtesy.
File it now
Conference sorry not interview.
I’d file and serve it ASAP and just tell the judge that it was an inadvertent mistake and that it’s been filed. If it’s federal court or a state court with e-filing, they may be able to pull it up on the spot even if it’s filed tonight or tomorrow morning.
Yeah you’re totally fine. Joint CMP conferences are all just formalities. Nothing material. Judge will prob not look over the filing until 2 minutes before the conference starts anyways. Happens all the time. Get some rest - you’ll be great 👍
$hit happens. If this is the worst blunder of the day, week or year you are golden. Do the filing asap and if the court asks just be honest. Truly no biggie.
File asap and explain to court asks at the conference. They should consider it
Straight to jail.
