I feel your pain. I highly recommend sending certified letters to your client advising of the offer, how you recommend they take it, and indicate that they will continue to accrue costs etc.
TOTALLY AGREE WITH THIS ☝🏾.
Further, amend your fee agreement with the the client. They are ignoring your advice which places them in breach of the K. Instead of terminating them on the spot for breach, amend the K: make them pay all hard costs accrued this far and an advance on all hard costs accruing going forward.
My retainer agreement has a clause that although they are the ones who have the decision-making power over a settlement, I have the ability at any time to require them to pay me a retainer to cover all future costs. This way if they want to ignore my advice and it’s looking very dire , they have to start funding the case themself. I have yet to see a client pony up any money; when it’s put in that perspective, they become more reasonable in evaluating the case .
