It’s ideal not to do that. I’m sure we all try to avoid it. I think sometimes it happens. I work through my pending matters (longer days/less breaks) before I leave and I’ve had to work on occasion. I’ve had to cover work when colleagues who don’t work hard/ are the kind of people who work 5 hours a day go on vacation so I try to avoid putting that on others. My F500 position was better for this than the position with a smaller 10 person team.
If you’re solo or at the top, it’s unlikely that you’ll 100% have a hands-off experience at nights/on PTO. If you’re part of a larger team/report up to another attorney, it’s significantly more likely.
In a 30 year in house career, I worked around 5 to 10 late nights a year and worked while on vacation once or twice.
