How do you define a “brilliant” lawyer? One could argue it’s still a meritocracy and that you (or those who proclaim meritocracy is dead) are not factoring in all aspects that are worthy of merit. If being a brilliant lawyer is based on one’s legal analysis alone, I’d say brilliance is not the highest goal. Had colleagues in law school and private practice who could analyze the law but could never translate it in practical meaningful ways for the client, had others who could schmooze with the best salesmen in the world but had no legal prowess. Ultimately, you need both and not many lawyers have both of those skill sets in spades. That being said - I tend to believe that mastering human relationships is far more valuable to our career success than mastering the law, or for that matter, any profession.
I worked in Big Law prior to working in-house and agree wholeheartedly - I still get disappointed by new outside counsel from time to time because they analyze the problem like a law school exam and it’s an irrelevant analysis. The goal is to end the dispute as quickly and cheaply as possible without attracting future similar issues. “Being right” under the law is only relevant to the extent it informs how quickly or cheaply we resolve the issue.

Law is a business. Partners promote associates who they believe will increase their income. Sometimes it’s the brilliant lawyers; sometimes it’s the mediocre attorneys that can attract business. They make a decision. They are not always right.
