Yes.
Welcome to litigation, my friend. I’ve been at this for 12 years and still feel that way.
As far as I’m concerned, if I stop feeling like that, it’s time to leave practice. You feel that way because you acknowledge that you’re fallible. You can make mistakes and to avoid those you must prepare. If you stop feeling that way it’s because you THINK you know it all. That’s when big mistakes start to happen.
This. My mom is a fabulous public speaker (also a lawyer) and she swears it’s because after all this time she still get very nervous when she has to do a speech, key note, whatever it is.
Welcome, friend.
The worst is yet to come, when the partner at trial starts asking you why you didn’t ask specific questions he wants to use in cross, but didn’t think about until after jury selection.
You just thought the better strategy was to save that line of questioning for trial, right?;)
Just took my tenth depo and I still feel like this every time.
It goes the other way too though - you leave feeling like you bombed and then the transcript is perfect, just roll with the punches (and get that time in!!!)
Welcome. Im now a litigation partner at V10 firm, and every dep, trial witness, court hearing is followed by my coulda/woulda/shoulda saids running through my head
Congrats on knocking out your first depo. It will get easier the more depos you take. Make an outline to make sure you hit all of your topics/important questions and if possible, have someone more experienced review your questions and exhibits (if any) before the depo.
