Los Angeles Superior Court changed their reservation system. Now motions must be filed within 3 days after the hearing reservation is made. If the motion is not filed within that time period, the reservation will be cancelled. This includes MSJ’s! Anyone else dreading the preparation of Ex Parte Motions?

Solano also does this. It’s one of the reasons I’m hesitant to file there! So nerve wracking especially for an MSJ.

I won’t say which other jurisdiction claims to do something like this, but hasn’t strictly enforced the rule (aka they say the reservation will be cancelled, but they don’t really do it) and it’s one reason why it’s one of the better counties to file in. 😊

It’s always just better to be prepared to file your motions ASAP after getting your hearing date!

The rule in all the counties where I filed in Florida was that the motion had to be filed enforce scheduling a hearing. What is the advantage to scheduling then filing?

Locks in a date. In LA Superior you may not be able to get an MSJ date for over a year and more than likely after your trial date.

Plus, there are strategic reasons for not wanting to serve the motion early.

I work in a firm that is known for litigation defense. I’ve been developing my own plaintiffs practice as well. I am able to pay the bills with my hourly defense work, which gives me time to focus on a handful of high value PI case a year on contingency. I was recently negotiating a case and was told part of the reason the claims rep/OC was jerking me around was because they didn’t see me as a plaintiffs attorney. Does anyone work at a firm where legal assistants don't do legal assistant things? For example, I have to do my scheduling and calendaring. I have to upload documents to our file management system. This morning, a name partners assistant didn't realize the name partner had a depo and didn't confirm it. This is how this firm as been for decades and it's incredibly frustrating to work this way. Is there such place as non toxic ID firm? Or does any of ID attys like what they do? I moved from general practice to an ID firm six months ago. Biggest mistake of my life.
