I would explain that to them but be prepared for them to not care. A PIP is typically a “death sentence” and a way for them to create a paper trail to document letting you go. It could be that they’re like “oh sorry thank you for bringing that up” but most likely they know and don’t care. HR is not your friend…they are there to protect the company.
If you like the job and want to fight for it, bring it up but if not, I think your energy is better spent looking for other employment. I’m sorry.
If you live in an at will state, this is not grounds for a lawsuit (like, say, discrimination would be)
I would have thought HR would have facilitated the PIP convo from the get-go. I'm sorry you're in this crappy spot, but really depends on what your end game is. If the PIP feels unreasonable, yes approaching HR to make sure you're being measured against appropriate expectations is a good step. HR will usually work with managers to come up w/a PIP that makes sense.
The goal for a PIP is improvement at the end of the day tho. If this has shattered your trust in your manager, and you're no longer driven to meet these improvements, then I'd start looking at an exit strategy while you still have a paycheck.
My goal is to get the largest severance package (or lawsuit settlement) because they are firing me based on a job description that I’ve never seen or signed before. The job description I signed is nothing like the job they are evaluating my performance on
If the PIP didn’t go through HR to begin with, that’s a red flag that false documentation is being created to force you out. And you should bring it to HR after saving copies for your personal records.
If the PIP did go through HR and it’s still inaccurate against your job description, you need to talk to a lawyer about how to make a case for wrongful termination, before you are terminated.
Either way, make copies of everything for your personal records, make detailed and dated notes in a bound notebook (not a spiral notebook) after every conversation with your manager and HR, and record any phone calls (if you’re in a state where one-party consent is legal for recording).
Is it at will employment? If so they can fire you for any reason. I’d consult a lawyer and get their advice if you’re considering a lawsuit.
Or don’t waste your time and money… from everything op has said, their employer sucks, but didn’t break any laws
There can not be a lawsuit in a at will state they would have to break the law and companies have tons of Lawyers on Stand By forall cases even when they do mess up. Find a new job if you feel there is a target on you always have a plan B and possibly a plan C I always have a plan B on stand by you do this through networking always if you want to be successful in this world sad but the truth. Best wishes to you
