You know that “3 co-equal branches of government” is a bunch of malarkey, yeah?

Congress is the supreme entity under the text of our Constitution. They alone make the laws. If they want to shave off a portion of their power into an executive agency (as the executive is better positioned for day to day management and enforcement of laws), they’re free to set terms and conditions. Judicial determination of constitutionality isn’t anywhere in Art 3, Marshall invented it.

Those aren’t even the real checks and balances on the legislative branch. Bicameralism splitting the houses with different terms and federalism splitting power between member states and the union.

Madison wasn’t saying Congress was more righteous or worthy of power than other branches, but that it simply was more powerful than the others. They make the laws, they control the budget, they can fire the most senior level members of the other 2 branches. They don’t pick those senior members, but have to confirm them. Look at the 14th amendment traitors spat. The people missing from that expansive list (P, VP, Art3 judges) are all folks that Congress already had the ability to fire.

Which makes the current neutering all the more impressive when you think about it…
