Threatened to file a Rule 11 sanctions motion against OC. I think the threat at was justified, but they took it way more seriously than anticipated, and I feel like this one got away from me. Would prefer to walk things back and let OC know I’m not actually planning on filing, but I can’t figure out the best way to do so without appearing to have caved.

I’m sorry you are going through this. This is a great lesson in “never threaten something you aren’t ready to go forward with.” Meaning, type up the Rule 11 motion first before threatening it.

Also, in some jurisdictions, threatening to file a Rule 11 is itself a violation of the rules of professional conduct. Either there is a violation or there is not. So, file or do not, but don’t threaten to file.

I would pick up the phone and talk to OC and see if you can work out the underlying issue.

I agree with FP1. “Never threaten to do anything you aren’t willing to go forward with” is an excellent piece of advice. A mentor told me this as first year associate, and I’ve never deviated from it. My line would be “if you continue behaving like this you’re leaving me lo option bit to consider rule 11. I don’t want to do it but let’s be professional here…” I have said that before.

A partner I used to work for wrote these threat letters on nearly every matter. It was his MO. If it was justified, and you don’t plan on doing anything about it, just let it go?

That really sucks.

Use it as a bargaining chip. Back down if they do what you want. That’s what I do when I’m in those situations. “Let’s work through this amicably. A rule 11 motion would cause more work for both of us so let’s work this out between us.”

like

Why threaten? If the motion is justified, file it. If not, you effed up and you should take the consequences humbly. Either way, never again should you threaten a motion you don’t already have outlined if not written.

like

It might be justified, but how many judges want to deal with this? When I’ve been threatened with rule 11, my response was always “bring it asshole.” They never did.

I’m trying to transfer departments at my company and I talked to the MD of the department i wanna transfer to, and told him working remotely is a requirement to me, and he said he’s not sure if that’s possible, and that would depend on HR and the hiring manager. He still forwarded my resume to HR and I got an interview. How should I negotiate to make the role fully remote?

Hey Fishes,

Recently got an offer from PharmEasy for the Data Analyst role with a 30 % hike from current salary at Deloitte, where CTC is 8.1 LPA
But will have to pay in the training cost along with the joining bonus which comes up to 2.4 lac. Really confused what to do as I've been on bench for 3 months now with no learning opportunity and don't know what kind of projects I might get ahead and what about the wlb as compared to PharmEasy.
Some insights will be much appreciated :)

Hi ,

May I know about the hybrid working model in IQVIA. What I got to know from HR is I may need to visit office once in a month or two or If any critical meetings. But not sure it will be the same in long term also. Can any IQVIAN's share their experience here, will be helpful.

Currently I work as a implementation consultant in a fast growing B2B SaaS company. We just recently received a funding round of 500M EUR, but I don’t have any stake in the company yet (only joined 5 months ago). I got an offer for EY-P but turns out the compensation is a bit lower than my current salary (~50kEUR). I’m really interested in strategy & PE cdd, but never done it before. I’m worried that the opportunity cost is too high if I leave my current company. Really appreciate some advice!

Q’s for hiring partners and recruiters - you know that most associates quit their managing attorneys and not the firm/case. I’m in that boat. What do I say to a prospective employer about the situation of why I want to jump ship?

Very brief background - I’m a senior associate who has been on one complex commercial litigation case for over a year. Over time, the relationships between attorneys on the case have deteriorated to the point that it is affecting my productivity/work. I want out.

Looking for tips from seniors. I'm at A1 level at a litigation firm, stepping out of the deer-in-headlights phase. With the Partners assigning work to me in teams of 2-3, there's potential for growth. But with the sheer amount and depth of work on each case it's challenging to take on a more "adult" role. I often find myself in a more assistive role, either by my choice or the Partners'.
How can I accelerate my progress? What are Partners' and Seniors' expectations from year one associates?

Any tips on getting out of document review?
I’m at the end of my ropes with this job. I had a job at my local prosecutor’s office after the bar (class of 2017) where I made $35,000. I left after 3 months to work in private practice because I wanted to be able to survive on my salary and not live in my parent’s basement (no success there). I did criminal defense and domestic relations cases and was absolutely miserable. I quit after 3 months and went into document review and now I’m stuck.
