What’s worse: doing a real estate deal where there’s no lawyer on the other side, or doing a real estate deal where the lawyer on the other side has never done a real estate deal before?

Having no opposing counsel but just a broker that advises their client as if they are both broker and lawyer…that’s the worst.

Especially a broker who is only dabbling in that sector.

Had a resi agent try to bully me once. She kept yelling “I’m a million dollar broker.” Ma’am, you won’t be if we don’t get this million dollar deal closed.

Hard to say. It depends on whether the lawyer on the other side is trying to learn something or trying to fake it. Someone insecure is going to say no to every request. You’ll get a lot less push back with no lawyer most of the time. There are a bunch that will want everything simplified and don’t understand that there is a need for certain language

No lawyer on the other side? What area are you in where a lawyer isn't necessary?

Smallish deals, or lots of states don’t have a custom where lawyers are involved in resi deals.

No opposing counsel is more work, but an uninformed lawyer is more difficult.

I’m in FDD… I know I signed up for this but there’s something about the anxiety that comes on a Friday knowing that we still didn’t get access to VDR .. and how that anxiety grows as you enter the long weekend knowing that access can happen at any minute (or not) and you have to tippy-toe on the idea of potentially cancelling on your memorial weekend plans. Anyone live with a general plat exception rather than insisting upon the title company specifying the matters on plat which constitute exceptions? This deal is in Source Carolina, but I don’t think the title company is pushing back because of any state law issue. I’m not accepting the broad exception, but I’m curious how often others do accept that.

Pro se plaintiff, an attorney, filed a complaint alleging mold defects after closing on a property. Client, layperson, may have agreed orally to a settlement amount without proof of damages prior to filing appearance and obtaining an attorney. Client filed appearance pro se, then plaintiff sent over a draft settlement agreement few weeks later which client didn’t sign. Client then got an attorney, filed answer, etc. Can this oral agreement be voided for coercion, indefinite mat’l term, etc?
