Working on an emotionally challenging case, and it’s tough not to take it home with me. Any tips on mentally 'leaving the case at work'? How do you all manage the emotional side of litigation?

It is vital that we learn to compartmentalize. We work to live not live to work. Focus on family first ALWAYS, stay in good physical shape, commiserate with others in your shoes and help them when you can. Practice mindfulness, and don't be afraid to ask for help

If the case is emotionally challenging because it triggers past trauma you have experienced, the burden can be even worse.

I suggest working with a trauma-informed therapist who can help you identify and work through vicarious trauma and triggers.

You may want to brainstorm ideas to buffer yourself from the most difficult content, like spreading out review of case files with disturbing content with others.

I agree with Senior Litigation Attorney 1: you will eventually learn to compartmentalize. All of the suggestions were excellent, not that anyone needs my approval. If it's really hard to get out of your mind, then my advic is: distraction, distraction, distraction. Do things to keep your mind on other things. Read or bindge watch a series (good advice only in such situations). If I need to keep my mind from wandering and feeding into an emotion, I need to find something to space out on, for lack of a better term.

I have a governmental entity client in Texas that wants to offer 6 weeks of paid parental leave for all employees, even those who aren’t eligible for FMLA. After the paid 6 weeks, the employee can choose to continue paid leave using any accrued personal leave.

Texas does not have a paid parental leave statute.

If paid leave above what is required is offered for parents, do we also have to provide the same benefit to other employees that are eligible for unpaid leave?

Does anyone work at a firm where legal assistants don't do legal assistant things? For example, I have to do my scheduling and calendaring. I have to upload documents to our file management system. This morning, a name partners assistant didn't realize the name partner had a depo and didn't confirm it. This is how this firm as been for decades and it's incredibly frustrating to work this way. It's so hard to not stress over this daily.

FL peoples: I signed a lease for a new place to start May 1 as my current landlord sold the unit I'm in. Turns out, the buyer wants to keep renting the unit and asked if I want to stay. Of course I want to stay. My new lease hasn't started so I'm pretty sure I can easily back out. For the new lease, I'm still pending full approval from a condo association as I have to do an in person interview. I have paid first months rent in advance. Is there anyway to get that money back?

Trying to get ahead of my caseload feels like trying to climb a hill made of loosely-packed pebbles. No matter how much I scrabble, I’m sliding closer and closer to the bottom.

How do you get caught up (or even ahead) when you’re always behind? Assume that all things that can be offloaded have been offloaded. I cannot take one more all nighter trying to get a motion drafted two days before the deadline because I couldn’t get to it earlier.

Does anyone else constantly put off putting their time in as they go and then hate their life at the end of the month? Then once you get caught up, you don’t want to enter more time, and so you fall behind again. It’s a vicious cycle.

I work in a firm that is known for litigation defense. I’ve been developing my own plaintiffs practice as well. I am able to pay the bills with my hourly defense work, which gives me time to focus on a handful of high value PI case a year on contingency. I was recently negotiating a case and was told part of the reason the claims rep/OC was jerking me around was because they didn’t see me as a plaintiffs attorney. Is there any way to change this perception or does it just come over time?

It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.
