Usually easier to get that clearance as an in-house lawyer given there’s no malpractice insurance issues for your employer to juggle. Just be mindful that your productivity doesn’t dip or they might try to rescind the approval. This can be particularly tricky if you are already working around the clock and now trying to clawback some of those post 5pm hours to sell them elsewhere
I am considering the same thing but contract related in a different industry— my current industry is niche. My employer only requires disclosure of conflicts and competition, but no approval or restrictions on outside business activities or outside legal work.
From my experience, no law firm would allow their lawyers to moonlight on the side. They expect their lawyers to be either practicing law or doing something related to business development. Malpractice insurance as well as conflicts are additional issues. I wouldn’t ask a law firm if i could practice law on the side. The boundary between strategy development and law practice, if any, is very thin.
