Hi all. A title/survey question - Is there any endorsement or other affirmative coverage that can be obtained for an owner’s policy in NYC for some minor encroachments after title did a survey reading?

New York is not a filed state (i.e., they won’t give you form endorsements) so you can request affirmative coverage but you have to formulate it yourself.

Ask the title company you’re working with for an enforced removal endorsement and see what’s available. The question you really need to ask is, what’s the impact of the encroachment if you can’t get title coverage? (Does it impact rebuildability, is the area encroached upon restricted in some manner that limits usage for the property, does the encroachment after reading the underlying documents matter)

In my state, we would request an ALTA 9.2.

In terms of process, it would be common practice for us to ask the title company for a list of availability and pricing for endorsements at the start of each transaction.

I have a multi-state practice so recognize each state has its own quirks, but I don’t think requesting a list of available endorsements will make you look like a rube.

Pro se plaintiff, an attorney, filed a complaint alleging mold defects after closing on a property. Client, layperson, may have agreed orally to a settlement amount without proof of damages prior to filing appearance and obtaining an attorney. Client filed appearance pro se, then plaintiff sent over a draft settlement agreement few weeks later which client didn’t sign. Client then got an attorney, filed answer, etc. Can this oral agreement be voided for coercion, indefinite mat’l term, etc?

Any advice on shifting from association law to commercial real estate in FL?

I've been applying to jobs for months but every position wants at least 2yrs of experience in real estate transactions, usually way more. I'm at 1yr+ doing HOA/condo work but have had no opportunity to do real estate transactions like I expected. Seems like the only way to get the experience is to have nailed a big law gig right out of school and get put into that practice.

Looking for a bit of insight on how commission or bonus is structured on flat rate residential real estate at Canadian law firms. I was offered a good base salary and I was asked what type of structure I was looking for. I am uncertain as to what is considered standard or what to look for in terms of bonus/commission structure. Any insight is appreciated!

Has anyone ever heard of this type of real estate private equity fund structure:

-One LLC, so only one PPM
-Multiple investors that can be onboarded anytime
-Multiple investments that investors can determine whether or not they want to invest in
-One K-1 per investor based on their investments and income
-Ability for the Sponsor/Fund to invest directly, indirectly and in equity, debt, Pref, etc.
To me this seems extremely cumbersome and would require multiple classes of (cont’d)
