Hi—my fiance has a valid H1B but the stamping is expired and he has an appointment for stamping in India in Nov. Given the new H1B news, should they travel or not?

What options are on the table: a. overstay in the US with an expired visa perhaps for another 6-8 months or b. travel out of the US to get the visa stamp with the possibility of unable to swiftly come back. Though the proclamation says its for 'new', that may get changed overnight to cover more grounds and restrictions (we know this can happen) or the airport arrival customs may interpret the changing rules which can inconvenience you

1.) This is NOT an annual fee. It’s a one-time fee that applies only to the petition.

2.) Those who already hold H-1B visas and are currently outside of the country right now will NOT be charged $100,000 to re-enter.

H-1B visa holders can leave and re-enter the country to the same extent as they normally would; whatever ability they have to do that is not impacted by yesterday’s proclamation.

3.) This applies only to new visas, not renewals, and not current visa holders.

It will first apply in the next upcoming lottery cycle.

What if some one’s H1-B expired (but still have couple unused years out of 6) earlier this year - can they still enter the country after couple years without this 100 K fee?
