According to the IRS' website,it still must be declared as income.
So you want to impact their tax refund instead of their regular paycheck? As an employee who was previously impacted by something like this, it can be a nasty surprise.
It’s allowed, but the value of the gift card is considered income by the IRS. The taxes will be assessed when they file taxes vs on the paycheck.
FYI - there is *potential* for an employer trying to end up in hot water with the IRS. Common scenarios where trying to help out an employee in a pinch becomes assisting/structuring a scheme to evade taxes involve paying an employee in cash/cash equivalents, off the books, or other “reporting optional” methods, paying a third party in lieu of directly paying the employee, holding off on issuing the paycheck until after a tax/legal matter is resolved. Obviously issuing a $2500 bi weekly money order x 3 pay periods is different than a $50 holiday gift card, but it’s worth pointing out the risk to the employer.
