I’m a second year associate at a small, but reputable firm. My caseload is almost entirely made up of clients who were referred to one of the partners but the partners are too busy so I end up taking the case. The clients are told up front that an associate, rather than a partner will be taking his/her case. I’ve run into an issue a couple of times where the client doubts my advice because I am only 2 years in. Has anyone else experienced this? How do I address the fact that I’m only 2 years in?

I am failing to sell them on the importance of strategy and taking a step back. Honestly, I don't even know that I'm sold on it. But I feel like it's important. However, it is far away, and will require 1h+ train/car commute vs. 10 min biking right now. We are scared it will bite us back at some point, although COVID helped w/ remote working being a new norm. The project will be done 2024, so I hope to have a more relax job by then. What are your client follow-up/communication policies or practices? I’m hearing more and more that clients don’t like the long periods of time with little to no contact. From my perspective, since I bill for my time, unless I have an update or need something, I don’t initiate a call. Also, clients hold on to important info and don’t initiate a call cause they’re waiting for me to communicate with them.

In OAH the NCP has submitted no actual earnings only hand written sched c (Uber). NCP lied under oath about how pmt for the car was made. Said a friend paid for it and he is paying a friend back. Let's talk unhinged pro se opposing parties. We have one that emails the entire firm every few days with these SCREEDS that are like weird stream of consciousness accusations of baseless criminal and unethical conduct. So far there have been 2 emails already today. A GAL has been appointed and ordered to do a psych eval on this party, but is there any sense in responding in the mean time? Everything we say seems to get twisted.

How does everyone bill for family law matters? Do you always bill hourly or is there some flat fee, monthly or quarterly fee structure that could work, even in contested matters? I have cases that the clients end up spending $20-$40,000 on a contested divorce and this is really out of their budget. I feel that if my firm could charge a flat fee of $10-$15,000, it would still be beneficial from a client predictability and volume standpoint and would generate more referrals.

Working on a divorce where the father is claiming that he is unemployed because of the previous administration’s actions with DACA (he was brought to the States as a child). I know that the memo rescinding DACA was ultimately vacated—but OC is unsure whether this would count as voluntary unemployment for child support purposes. I believe it does as the application period to renew DACA benefits was reopened in 2020. Thoughts?
