Quick California civil procedure question - is a defendant required to file a cmc statement even though it has not yet filed a responsive pleading to the complaint? Plaintiff delayed in serving the complaint but the court set a cmc date at the time the complaint was filed. Now the cmc is scheduled for a week after our answer is due, as a result of the delayed service. What are the requirements for the cmc statement? There are tons of distraction while you are working on something and then you are supposed to be within the budgeted hours which are always low. There is so much non-chargeable stuff going on.
