Is there anyone in your network who's like 65? I'd ask them, chances are they've came across it
The timeframe should be in either the agreement which requires arbitration or the AAA rules on their website.
It is not in the agreement. We are under the AAA Consumer Rules and the Consumer Rules do not specify.
Was your case stayed or dismissed?
The case is stayed. The arbitration agreement does not specify a time to file the demand.
California statute addresses this. Check your local jurisdictional rules.
I’m in Texas and don’t believe it has one. I actually came across the California statute in my research. Thanks anyways.
F bc I didn’t think so but I’m a moron so.
Do the AAA rules say anything generic that would be interpreted as the usual statute of limitations, i.e., whatever it would be in court? I can’t remember the language but this is the setup for employment cases if there’s no agreed SOL. if there’s truly not anything I’d argue for the same SOL you would get in litigation. I’ve also looked to the state law most analogous, in a case when there federal sol did not apply but those were very unusual circumstances.
