Is “commercial litigation” just basically representing clients that have commercial general liability insurance policies?

Also, commercial litigation you are generally retained by the client directly. Commercial insurance litigation you’re typically selected by the carrier (have to be pre-approved on a panel of firms) and assigned to the client.

If you’re litigating by way of an insurance policy … you’re doing ID. If you’re litigating for commercial entities without answering to an insurance carrier … you’re doing commercial litigation.

This is not quite right…. Very common for commercial cases to still involve answering to an insurance carrier who is either paying bills along the way or expects to be responsible for all/part of any judgment/settlement/legal fees at some point. The insurer is not the actual client, but the client usually wants to keep them happy and looping them in / answering to them can be part of maintaining the indemnification obligation

No, it's usually a contract dispute of some kind. A businesses CGL/commercial general liability covers claims of bodily injury, property damage, physical harm, etc, and they usually exclude coverage of any sort of contractual dispute so that why insurance isn't usually involved in most commercial litigation.

Clearly I am new to law haha but you explained this perfectly where I understood it

Commercial litigation is general litigation for commercial clients

Yeah I’m trying to learn bro thanks for your help!!!!!

No. Depending on the jurisdiction it can mean different things. But a good umbrella is litigation regarding commercial clients. In NY commercial litigation has different rules than civil litigation

Transactional associate. Lateraled 6 months ago and one of the biggest pain points has been my new firm’s inclination to “hop on a call”, which of course requires every single stakeholder to join. It’s destroying my ability to get anything done during the day. It’s a complete performance and it drives me nuts.
