Is it appropriate to ask in an interview why a job posting has been up for so long (going over a year now). To me, a posting up that long seems like a red flag so I am genuinely curious.

I asked once. Got a somewhat honest answer (maybe). Was offered the job that day anyways. I asked to think it through the weekend and they said okay but also the last person they interviewed accepted on the spot. The following day, I sent an email with some fairly standard questions, especially since there was no offer letter. They responded by saying they wanted someone excited about that job and if I have to ask questions, then maybe this isn’t the job for me.

And with that, I received the full answer to my question lol.

Maybe there’s a back door way to do it. Like, “I’ve been interested in the firm for awhile. I think I saw a similar post up awhile back, are you looking for a second person on this team?”

Firms often have postings up for long periods of time by mistake or just as a way to collect resumes so the need and urgency can ebb and flow while a posting stays up for a while. There's really nothing to gain from asking since the partners don't even concern themselves with the postings. You can ask something like how long they've been looking if you feel you must ask

Research the company, that may give you some insight as to how it is performing, the employees and the financial growth. I wouldn't necessarily ask why it has been vacant for so long. It may not be for a bad reason. The Employer may have been looking for a certain type of candidate and may think of you as it. Look at the glass as not half empty but half full. They picked you for a reason go in there and let them know that they made a great choice!!!!

It could be a red flag. I don’t think it’s this long but our HR team posts jobs when we’re casually looking. Not actively needing to fill a role but if someone great applies we interview and hire.

I would just ask a lot of questions about the firm and the role. If someone accepted and hated it they would have probably taken it down, so if there are big problems you’d hopefully see them before you accept.

No. Get the offer, then ask to have a 10 minute call with a senior associate first. Be honest and just ask then, they won't revoked the offer.

About to turn down a job offer that would nearly double my salary after speaking to several former associates of the firm and hearing some not so great things. The word “sweatshop” was used multiple times yet I am still having a hard time wrapping my head around it. This is truly “you can’t pay me enough to be part of that” in action. Does anyone know how litigation finance works on the plaintiff side? If someone wanted to bring a lawsuit against their former employer would a general contingency arrangement with a plaintiff’s firm make sense? Horrible anxiety about considering a new job....
I was one of the big firm stealth layoffs in covid and joined a boutique firm in Sept. They came sort of close to matching my salary but I moved to SoCal and have an opportunity to jump back in to big law and get $100k raise. The people at the small firm are so nice, but hours are nuts and if I’m going to work this much, I might as well get paid more, right? Is it too soon? How do you tell them when the managing partner took you under his wing?

Just had a hearing on my motion to compel where OC told the judge we hadn’t conferred before filing the motion. Not only did I attempt to confer on 3 separate dates, I attached the emails and his response that he refused to confer to my motion. Judge didn’t care, as soon as she heard him say we hadn’t conferred she denied the motion. Not asking a question, just needed to vent.

Negotiating a settlement. I’m at $10k, opposing counsel is at $20k. My client won’t go higher than $15k. OC has come down to 17.5k and says his client won’t budge from that. Do I offer 12.5k so we can hopefully meet in the middle at 15k? Is that how the settlement game is played? Seems dumb we can’t just say let’s meet in the middle now and be done with this. (I’m a first year, first time negotiating a settlement on my own and I don’t want to screw this up!)
