Is your attorneys making you use your vacation time for state of emergency storms?? The office was closed but he said we need to use vacation to be paid on that day. Is this reasonable ??

My favorite was the time the Mayor of Los Angeles publicly closed the city after the Northridge earthquake. But because nobody showed up to work, we were all required to use a vacation day.

Contrast that with 9/11. Everyone got the day off with pay.

Reasonable? No. Legal? Depends on what state you are in, but for the most part the employer is not required to pay non-exempt employees for days not worked due to such circumstances. So, if an employee wishes to receive pay for a day/days not worked, using vacation/PTO is the only way to do that.

The rule of thumb was iolf the office is closed by mgmt then it's a.paid day off. But is it small solo practitioner & between 10-50 employees? 1st of all solo practitioners can be a nightmare to work with. BTDT more than once. But with that small number of employees he found the gray area loophole & doesnt have to follow standard govt employment rules. I learned that lesson the hard way too. Be careful if layoffs happen or if you quit. He will probably fight to keep from paying you unemployment & state labor boards usually side with the employer in disputes like this. Their word against yours & a licensed attorney has clout & standing. Good luck 💕

Currently a paralegal at a small start up financial services company been there for just a little over a year. I wear “multiple hats” but more recently I’ve done a lot of PM work and some BA work. So I have my bachelors in criminal justice and I just finished my paralegal certificate course today. My attorney should be making partner this year. With that being said I told her that I would complete my certificate by the summer around the time she would make partner.
