I’ve noticed a lot of lateral movement in patent litigation lately. Just today there was a big move from Winston to King & Spalding, and more recently moves from Latham to Cleary, among others. What’s interesting is that many of these moves seem to be down the Vault rankings.

Does this suggest that lower-ranked firms are paying up to build patent lit practices? Or is patent litigation slowly being pushed out of the traditional top-Vault BigLaw model?

Probably just getting better deals from moving to other firms. That or moving to avoid conflicts with a major part of their book.

Also worth noting that partners with IPR-heavy practices have had to start shifting back to litigation as the PTAB institution denial rate has skyrocketed. They might have to move firms to do so or they might displace some people at their current firms.

My guess is money. The amount of recruiter emails I get about firms looking for partners or counsel with books of business has been increasing recently.

Probably both. So much demand from firms that just need depth while others have too many mouths to feed. Fantastic time to be a partner in this space with a moderate book.

How would you approach an interview process where the company sounds exciting but you feel confident the role would not be a growth opportunity for your skill set? Career advice?

I'm a relatively junior data engineer (2yoe), the only other engineer (senior) that trained me left about a 6 months ago and I negotiated a nice raise for the extra responsibilities.

My performance reviews have been stellar, but my manager is starting to look to hire a senior to help me deliver projects as we do lack capacity right now.

I feel like I might be missing an opportunity to ask for a promotion and hire a junior instead.

What was the hardest class year for you? I used to think first year was by far the hardest but now I’m a third year and I’m really feeling the pressure to step up. I work in finance and at this point I’m expected to handle closing documents, manage first years, draft some portions of major docs, etc. I feel like I’m always frazzled, constantly second guessing if I handled something correctly and anxious to answer calls from clients/OC. Why do firms fire people with low but still profitable hours? I am in my first full year on track for pretty low hours (~1500) but the actual realized fees (after writedowns) are still double my yearly salary.
