My H1-B visa stamp with PwC is expired but I have a valid I-797from new employer. Can I travel for work to Canada without getting the new H1-B stamping ?

I’m a former forensic scientist that left the field several years ago. I recently received a subpoena from a case I worked and suggested to DA to have evidence re-worked by the lab or stipulation. If I am required to testify (as an expert witness), I would need to book a flight, hotel, etc. My question is this: can I ask for my requested hourly rate, travel, and hotel to be covered when speaking with DA or is that “not how this works” as the investigator put it?
