A former head of DEI/HR for our institution felt that white males were not a member of a protected class. Therefore, she felt that white males could not be discriminated against based on sex/race. Federal OEO says that white males are a member of a protected class despite not being a member of a minority. Given that this director may have allowed their bias to impact Title IX investigations, are there any reporting requirements for this person's conduct now that they have left? Thoughts?

This sounds like an issue for your in house counsel. They'll likely need to engage external support to determine level of exposure and they'll quarterback everything else going forward. There shouldn't be any reporting requirement as far as I know. Good luck!

Whoever was a damaged party may want to contact their nearest federal district court. They often offer free legal aid, and Title IX damages fall within federal jurisdiction.

But don’t take it from me, some might say: signed, a silly and failing ol’ DEI consultant 😂

Latinx - help! We used this term in our diversity spotlight discussing Hispanic Heritage Month. One individual said that in English a group of Latinos would just be Latins to be gender neutral. Been for a company for over 2years. The executive team is very much a boy's club. There are a few women in management roles but zero ethnicity diversity there. I raised my concern to HR in feb. I've observed so many corporate versions become an advertising strategy (SM posts, diversity reports) without doing the actual work (increasing representation in senior leadership, salary analyses, having an effective reporting system for bias).
