Get severance! And unemployment. in some states you can get both.

Why give notice? They will just get fired on notice. Anything more than a month and the firm isn’t going to keep them around if they’ve already been put on probation.

Is there any benefit to giving notice? Some firms escort you to the door the moment you do that because they don’t want you taking client contact info or work product. It also seems likely that he wouldn’t get severance if he leaves voluntarily and might cheat himself out of unemployment eligibility.

I have no direct experience here but I think giving any notice right now will backfire and they will either walk you out or give you a few weeks to wrap things up- that’s it. If this were me and I needed the money, I would bust ass at the firm to make money, increase my network, and leave on the best terms possible (never know who your future clients will be or if you need to return to that firm later).

EOY is still far away. Your friend should improve, keep their job through the end of the year, and negotiate severance if this is the case.

Your friend cannot count on getting additional time after the end of the year. It’s entirely possible that the firm has another chat with them in October and November and says “things haven’t improved, so your last day here will be December 31.” Or even less time than that. Notice (especially multiple months notice) will not do anything for your friend.
If they want to maximize income for as long as possible, doing really well *may* kick the can down the road a few more months. But make no mistake: by the time this conversation is being had, the decision has usually already been made. Absent very unusual circumstances your friend will not be able to work themselves back into good standing.

They need to leave. Do they want to disclose on all future bar apps that they were fired? Plus nit all firms give severance if they have given this much if a head's up.
For future jobs, You don’t have to disclose you were fired and it’s illegal for the firm to say so. What effect would getting fired have on your bar application? I had been fired a few times before my bar application and it was no problem. Quitting now would be giving up a lot of severance money.
