In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Write every kind of brief, appeals, argue motions, take depos. Am the only associate working directly under partner on all cases. In house or M&A/Real Estate Transactional are likely the end goal but want to get the litigation out of me first.

I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. We are assigned 50 cases a quarter and the top attorney clears $25K each quarter. This is my first time working at a PI firm. Can anyone share any guidance? Is 2.5% industry standard? Is it realistic to settle/resolve that many cases? I am trying to learn more about this niche before I counter-offer and attempt to negotiate.

I am a personal injury defense attorney and I’ve never done plaintiff’s work. I have a case where I suspect the plaintiff is malingering and exaggerating his injuries. The plaintiffs attorney has sent me multiple demands for $3 million dollars and basically begged me to respond with some offer. I have maybe 10-15 lit cases that I'm "responsible" for. Some of them are tar babies that I know the partners and my colleagues would hate taking over, but I don't think I'm willing to wait for resolution on them either. Thoughts?

How long does it take for an insurance adjuster to review a demand letter and contact with an offer? Fault is not contested in this case. I sent the demand and records 3 weeks ago. They contacted me after I sent it to confirm they received it.

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

What kind of split does your firm give you for bringing in cases? Trying to negotiate with my firm for an increase. Currently, I get 15% plus my base salary.
