Asked this in another bowl but it's L&E related so also asking here. I'm awaiting conflicts to clear to lateral to another firm. Partner just asked me to give a client my availability to start scheduling bargaining sessions with the union. How have any of you handled situations like this? It's very unlikely I'll be at my firm by the time any of the proposed dates occur and I'm being asked because our only other attorney who handles traditional labor issues has no availability.

Oh it's like day 2 of the wait. Of course I had a slow month while interviewing but now that I've accepted an offer and am waiting on conflicts everything is ramping up at the same time. lol.

You should tell the partner. This partner should be grateful you told him and didn’t schedule based on your availability only to have the client, union and partner pissed later if the date needs to be changed. Plus you risk the union alleging bad faith if the date is set and changed. As for you, I’ve never heard of conflicts not clearing for lateral associates. If you frame it as you are helping the partner and client out with your honestly you can ask him for discretion. If he’s cool he won’t tell anyone regardless. Worst case you get fired but your looking to leave anyways so you will just get a longer break between firms. This seems easy to explain in future interviews if asked.

Case load= malpractice? Small plaintiff’s firm of 25 attorneys. I was a 2 year associate hired and given 50 active files in pre litigation status. 9 mos later a partner quit and I inherited 45 more. I got up to 105 files. Now I hover at 85 active files in varying stages of pre lit. I asked managing partner for help and was told to settle more claims to lessen my load. Is this what people consider negative work culture?

What is considered a “large” caseload in employment litigation? I work at a large L&E boutique law firm and handling about 14-15 active litigation cases in state/federal court or arbitration. Some of these matters are multi-plaintiff and multi-defendant cases, but none are class actions. This does not include any matters I am handling in the charge stage or in pre-litigation. Not sure if that’s a typical caseload or not?

I have a governmental entity client in Texas that wants to offer 6 weeks of paid parental leave for all employees, even those who aren’t eligible for FMLA. After the paid 6 weeks, the employee can choose to continue paid leave using any accrued personal leave.

Texas does not have a paid parental leave statute.

If paid leave above what is required is offered for parents, do we also have to provide the same benefit to other employees that are eligible for unpaid leave?

Hello, I’m an associate (almost at the one year mark) at a midsize firm on the EPL team. I did about 2 years of employment law as a clerk during school and know that’s what I want to go into. I’ve asked for more EPL work but keep catching PI cases. I second-chaired an employment trial but don’t see any EPL work for the foreseeable future and wasn’t getting as much EPL exposure as I wanted before the trial. Any advice on a lateral move to a bigger firm with a broader range of EPL work?
