Currently interviewing for an associate medical malpractice position. Any help for preparing what to expect or what you think of the industry? I do not have a medical background so I am aware that the medical side is a constant learning curve. Thank!

Don’t try to act like you know anything about the medical field. Google will be your best friend. It’s a fascinating subject matter, but at the end of the day, it’s just negligence. Also, insurance companies suck. Be prepared to be creative with your Billings and still get time cuts from the ins company. I’m a new associate as well to MM and litigation in general and by far, dealing with insurance is the worst part about med mal (defense side).

I do enjoy the work. I think it’s pretty cool to learn all types of medical science - the stuff i completely ignored in high school and avoided in college. There’s plenty of work and cases will go to trial. However, I’m of the opinion that any job is as enjoyable as the people you work with/for.

I work in medical malpractice and I absolutely love it. There is a learning curve with the medical aspects particularly if you don’t have any medical background which I didn’t when I started. This is one of those rare areas of law that still pretty regularly goes to trial in the civil arena

Make sure you know your state’s technical rules for the field. Do you need an affidavit of merit before getting started? In NJ you do for med mal claims. Do a little digging beforehand so you sound knowledgeable and it shows you prepared.

Follow up post to my last post…My husband was laid off from the company where I also work. I am feeling really isolated / depressed about working and moving forward. However, firm X’s offer validity about to run out. Hello all, I'm a very green attorney, never tried a single case or even was second or third chair, but managed to land a litigation associate position at a Plaintiff's firm. Does anyone remember their first trial? How did you feel and how did it turn out by comparison? Anything you wish you did differently?
I know in THEORY what the process of trials are but thanks to COVID I haven't been able to observe them in real life so I'm very nervous for the day I finally enter a courtroom.

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

New to PI. I filed suit and know policy limits ($500k). I want $1M but I have to live in reality. Insurance company wants to know if I have a demand. Is there any reason why I’d demand more than the policy limits?

A defendant generally is liable for all harmful results that are the normal incidents of and within the increased risk caused by their negligent acts. If a defendant's negligence was a substantial factor in producing the plaintiff's injuries, the element of proximate cause has been satisfied and the defendant would not be relieved from liability for those injuries even though another force concurred..

What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Write every kind of brief, appeals, argue motions, take depos. Am the only associate working directly under partner on all cases. I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. I hate this profession/career more and more each year. Has anybody been successful breaking off on their own in recent years? Advice?

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.
