I'm in NY, and the biggest roadblocks are local regulations and zoning. Every city or town has its own set of rules, so what’s allowed in one area might be restricted just a few miles away. Many places require the property owner to live in the main house if you’re renting out the ADU, and there are often strict guidelines on minimum size, foundation requirements, and lease length (usually at least 30 days). Getting permits can be time-consuming, and neighborhood resistance can also slow things down. Plus, the upfront costs for construction and meeting all the codes can add up quickly..
Not those states but several towns in MA have passed laws against ADUs being used as STRs. But using them as LTRs is easier…it’s actually encouraged here to help with housing constraints.
