Yes, absolutely. It really depends on the circumstances as to what, if anything, can be done. Some attorneys can and do cherry-pick their cases for venue, others leave litigation (avoid it), still others become politically active and angle to become a judge to try to change the system from within. And some litigators just keep at it, doing their best under the circumstances and forewarning their clients of the bias that is likely to be encountered in that circuit.
