How hard is it to get back into litigation or IP after going in-house? I was a boutique 5th year in IP Litigation and some transaction work (hard IP patent, some trademark/tradesecret/copyright, I have an engineering degree). I recently took a role in-house doing soft-IP and related consumer-facing marketing law. I'm wondering if I've wedded myself to the in-house path going forward or if the litigation door could reopen in the future. Thoughts?

For me it was much easier than getting another in-house job. I spent about 2 years looking for another in-house job. But a recruiter got me a job at a law firm in 5 months.

Don’t stay more than 2 years in-house and you should be good to get back into private practice, but be prepared for a potential class back. If you already realize it’s not for you, getting out sooner is a better option.

I’m junior to two Legal Counsel (I work in-house) who are passive aggressive towards each other. They don’t attend each other’s meetings and leave each other out of email CC’s. It’s pretty clear this is done on purpose as one of them has bitched to me about the other.

What would you do in this situation?

Negotiating a settlement. I’m at $10k, opposing counsel is at $20k. My client won’t go higher than $15k. OC has come down to 17.5k and says his client won’t budge from that. Do I offer 12.5k so we can hopefully meet in the middle at 15k? Is that how the settlement game is played? Seems dumb we can’t just say let’s meet in the middle now and be done with this. (I’m a first year, first time negotiating a settlement on my own and I don’t want to screw this up!)

Does anyone know how litigation finance works on the plaintiff side? If someone wanted to bring a lawsuit against their former employer would a general contingency arrangement with a plaintiff’s firm make sense?
