I had a trial last week. Intellectually I understand how to effectively write a direct and cross, but in the court room when the witness freezes up, I have a hard time opening them back up. Some of the witnesses I prepped so hard with just sort of fell flat at trial and I feel responsible. This was my 4th trial through verdict and I haven’t been first chair yet. Intimidated by seasoned attorneys, but I love this stuff. Any advice on how you found your voice in the courtroom? Is it repetition?

Are the witnesses freezing up on direct or cross? I think on direct you can make things more conversational. Instead of a strict outline write the answers to the questions you want and sort of come up with the questions as you go. That may make it more conversational. Just an idea. Far from an expert. I think overprepping can make testimony seem too stilted

I totally agree. An exact script is what throws a lot of attorneys off when things don’t go their way. There are different ways to prep to try and avoid this — doing vague outline of chapters, or like you said where you list the facts you want admitted and then keep going till you get there!

I’ve been working at Deloitte (federal) for 4 months now at the analyst level doing the typical analyst work, like building decks. Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting.
