I have accepted a position as an administrative assistant which only pays once a month. When I looked this up, I found this is illegal in the state of NJ. I really need the job, and have had no other offers. If I question this after signing the employment agreement, I fear that I would lose this opportunity. Any advice would be much appreciated.

Look at it firstly as bargaining leverage while continuing to look for another job. An important factor here is the size of the firm that hired you and whether the law applies to companies to any size or only applies to companies with a specific number of employees. I am definitely not an attorney licensed in the state of New Jersey so the best advice I can give you and actually the only advice I am required to provide to give you ethically is to contact an attorney who is competent licensed in the state of New Jersey to obtain his advice or opinion. You need to know you are correct as to your understanding of the law and to explore all options. That said, and assuming you are correct as to your understanding of the law but you are needing a job and cannot afford to be unemployed, you may have to wait before complaining. On the other hand, you could raise the issue now as a whistleblower. You need an attorney in New Jersey.

Taking a job that you know is violating employment rules with the intention to make a complaint is so hostile. The only advice there is if you don't approve is to report and move along. Don't go in there like a kamikaze. You have no clue the enemies you can make or how connected the firm is.

It depends on your duties. FLSA classifies an employee based on certain criteria. The skills test breaks that down. If you are an admin that performs in a routine clerical capacity then you are entitled to hourly pay and overtime over 40 hours typically every two weeks. If you are an admin that is handling operations for a company and have discretion or judgement in areas of the business and also if the pay is over the minimum threshold which should be $684 per week then it is normally salaried. (Check NJ rules as the laws change quite frequently)

You have to check the job duties you will be performing first against FLSA skills and duties test to know how you are really being classified. Just check the DOL for more info
