I just found out our agency’s top producer is allowed to skirt compliance “as long as he brings in deals.” Meanwhile, I got a warning for sending one email with the wrong disclaimer. Is this normal? Or are we just letting rainmakers run wild?

You may want to look into your compliance with that regulation because in some instances you may be held personally liable in addition to your company should a regulator or someone else come in and discover the compliance breach. Just because something is wrong doesn’t mean you should not state that it’s wrong or not do anything about it. If you work for a company that has an ethics department in many cases if you knew about it, you are complicit. If you never reported it, you are complicit.

In my experience it’s normal. Is it right, no. Can we do anything about it, typically not in my experience.

When I was at NYL, they didn't do that. You would get fired even if you were a top producer.

That’s a recipe for disaster including possible future lawsuits and regulatory fines.
