I was told that I was both (a) expected to find a new job by April, and (b) work my current matters, take on new work, show engagement, etc. Then in April they'll take a look at my work thus far and decide whether they will make a decision like termination. I guess this means I have a job until April, then they'll terminate me and at that point I will be getting severance / website time? Is that correct or should I just expect to get no severance / website time in April?

That's a bum deal. I would quiet quit and spend all my time looking for a new job.

You're out. Take the time to find a new job.

Your severance is now, most likely. It’s weird to tell you to find a new job before/put you on a PIP and they say they’ll make a decision later. They already made the decision and if they are strapped for cash… this is your severance period. They are just using you and dont want to give you free money. Its typically not this way but in your case, i wouldn’t risk sitting around expecting severance

like

Yup. They’re being cheap. They want to get rid of you now and know they’d owe severance. But they can’t stomach the idea of you not also continuing to make them money during that time.

like

It’s garbled, but they’re basically telling you they’re going to fire you, but also soft-threatening you to keep doing work until they fire you.

You have to find a new job asap.

like

Yeah this sounds like a telephone-game version of a very standard PIP conversation. "Your performance has been subpar and we are formally putting you on a performance improvement plan, such that if you hit certain benchmarks by your next review date you will return to good standing. Informally, I have to say that I very rarely see people successfully return from a PIP and I would recommend you use this time to find a new role."

Honestly great advice

like

Yeah put all of your time into finding a job. Do bare minimum. They made a decision but very weird to put you on a “pip” but say to find something at the same time. PIPs are mostly always to get rid of you in any case but just strange how they handled it.

Severance is formal. You should have an agreement that outlines all the terms. It looks like you are still working and will get a final determination in April. You been put on notice.

like

This is bad advice, which I'm not surprised to hear from someone in HR. Read the writing on the wall: the determination has been made and you will be canned in April. You have 73 days to find a new gig.

Hire an attorney. My previous firm tried to do the same with me and as soon as an attorney was involved they said I can dedicate all the time to finding a new job and wouldn’t have to continue working.

like

I think you're confusing a few concepts here. If OP is at a large law firm, then they are at-will employee. If they are an at-will employee, they aren't entitled to severance. Most law firms give you a 3-month runway to find a new job, which is basically an informal version of severance. But, again, OP won't have a statutory right to severance - so an employment attorney won't really be able to do anything for OP. If there are potential harassment claims, then that is a different story.

like

So even though they told me they expect me to keep working, I should stop doing that? Like close out the deals I'm on and not volunteer for any more?

like

More specifically, you should prioritize getting a new job over doing anything additional for your current.

like

Several debated and concluded incorrectly that since OP has received notice that they should start looking for new employment and that severance would not follow. Nothing I said challenged whether OP should start looking. Honestly, OP should have been reading the handwriting in the wall long before a formal conversation. The signs were there and had been. The point was that severance is done by agreement not by conversation. Do I believe that OP was effectively terminated by the conversation? Yes but that doesn’t change the point that OP is still employed and can still receive severance once fired. OP should start looking immediately.

Good luck, OP. If /when you get terminated in April, ask for and get your severance and website which is fairly standard across Big Law. Hopefully you find new employment before then and this won’t be an issue. Associate 10, relax. Many of us in this group are lawyers and partners despite how our titles read. Concerning that you believe you can’t learn something from anyone else.
