Yes- L&E lawyer here. You are in the most employee-friendly jurisdiction in the country. In addition to federal protections under the PWFA & FMLA, you should have up to 4 months of job-protected Pregnancy Disability Leave (PDL), followed by up to 12 weeks of job-protected baby bonding under the California Family Rights Act (CFRA). Plus anything offered through your firm. Do what you need to do to keep your baby and yourself safe and document your requests.
Agree with everything LC 1 said above. Job protected leave is job protected leave, biglaw is not exempt. How that relates to billable hour expectations for the year, bonus eligibility etc. is really a question for your firm HR though. This isn’t the first time they’ve dealt with this and likely have a policy or at a minimum a standard practice for addressing this situation.
Please take FMLA time. I am on it now for IVF (just need a doctor’s note). I had a good friend lose her pregnancy due to overwork in biglaw. I believe FMLA may impact how much time you can take on mat leave, but I think getting safely to you due date is much more important.
Also, does this kind of leave reduce my pay during mat leave?
