I’ve done much better in regulatory overall! It’s easier for me to do deep dives to answer the question at hand, rather than plan out and get a brief drafted and proofread in time!
Yep, regulatory. Subject-matter expertise, longer deadlines (I’m in ERISA), and hyperfocus on issues. I tried lit for 6 months and ran. It helped that I was a CPA and found the idea of hiding money from the IRS intriguing. Also, if you’re early in your career, there are often openings for ERISA folks. Less in-house opportunities, though, so it balances out.

The answer is whatever you’re most interested in because interest is what makes your ADD focused enough to do deep dives. I loved litigation and excelled at it. I liked the constant frantic energy and switching of pace during a trial when something went a different way than what I was expecting and I figured out how to get back on track and win. I would’ve done horribly with regulatory practice as I would’ve been bored to tears. I would’ve been fired. Go with what you love the most.
That’s my fear. I love lit and am great at most of it but face the same challenges with time blindness and major briefs. Considering a switch to regulatory but worried I’ll end up working on a dozen different client matters in a day and never get the chance to get into hyper focus. Plus potential boredom
