Looking for ideas on how to handle the following: 10 attorney firm. Founding partner in his 80s and still comes in. Lately, he has become abusive to staff, angry, and making office miserable. 3 paralegals have complained about his fits.

Not sure how to change/approach this. I’m a junior partner who gets stuck with the fallout, hiring if people leave, and my life is now being made to be miserable too.

This person is not involved in the day-to-day anymore so when they come in, it's chaos.

You need to have a respectful “all business” discussion. Whatever that may look like. And do it in a way that he doesn’t think everyone else knows you’re having the conversation. Go to lunch or something off site where you won’t run in to employees.

honestly he doesn't have the right to do that when people are making complaints. No different than if he screwed up a case he can't just keep doing that you wouldn't let him touch the files anymore.

he has to have it said to him politely but clearly that his actions are dangering the profitability and reputation of the firm

Does anyone have any advice on how to deal with discrimination as an Asian in the workplace? In my company it seems like it’s a white boys club where and they just promote white ppl because they’re white. And then they have a lower bar for promotions for minorities (traditional minorities likes Hispanics and African Americans). Meanwhile they make Asians do all the work. Subs! Internal subbing is draining the life out of teachers. The sub schedule comes out at the last minute bc of so many teacher absences. It’s the split classes in one period (1/2 Gen Ed and a Special Ed class) Teachers on a cart. Subs pick up students and deliver students. Class changeovers take 10 minutes bc of the domino effect. We’re all waiting for next sub. Teachers are late for their own classes. Students are in chaos with rotating subs. We pay $100 a day. Is the Solution in plain sight?

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

Client has received 3 injections and a surgery rec for laser discectomy

Sent 2 policy limits demands. Adjuster offered $60k both times because they don’t see a “causal relationship” without offering us any articulated supporting facts.

The insured is a Radiologist, he appears to own a home valued over $2M.

Is this policy open? Best approach? Thoughts?

Bad faith lawyers out there- do you have success getting extracontractuals with blown policies that were achieved via technicalities or borderline deceptive set-ups? Do juries punish a carrier when their check is lost the mail due to a hurricane and a day late or some poor defense attorney accidentally left one line off of a release?

I am a personal injury defense attorney and I’ve never done plaintiff’s work. I have a case where I suspect the plaintiff is malingering and exaggerating his injuries. The plaintiffs attorney has sent me multiple demands for $3 million dollars and basically begged me to respond with some offer. I’ve told him the truth - my client has no interest in trying to settle if his demand remains about twenty times higher than the actual worst case (for us) jury verdict. More in comments...

Ethics Q: my client created fruaduant medical documents in order to try to recover extra benefits from her injury. My thought is to settle her case with insurance company for whatever nominal amount is offered ASAP. However, this might be lower than her case is actually worth despite the the fruad. I would rather end representation as soon as possible. Thoughts? California ethics apply.
