Maybe hire more Americans and pay them better?
Nah, not gonna happen. Probably use it as a reason to lay off even more people.
Theee are plenty of people in American that can do their job. They hire H1B to exploit them, and shortchange us.
This only affects new applicants, not that it’s not still horse shit.
All the folks going agencies will stop shortchanging American for cheap H1B labor. You gotta remember that the majority of agencies, across most roles, usually don’t sponsor visas (unless you’re exceptional).
Places like NYC are the global centers of advertising. And if you need a reminder, it takes more than just American talent to build global hubs like these. So stop with the immigrant hate.
In order to hire an H1b employee the company must pay that employee the “prevailing wage”. That’s the high end of the range. I’ve hired many H1b creatives. They bring a unique talent and perspective to the work. Because their very existence in the US depends on remaining employed, they tend to be more driven and are often the ones winning awards.
Also, it’s already very expensive and an arduous process to hire someone on an H1B so only the cream of the crop get in.
For an agency that wants to up their creative game, hiring a talented art director or designer from Brazil may be the best investment they can make.
I think this will make America less competitive. But here’s some context:
“In fiscal 2024, 71% of the H-1B petitions approved by the USCIS went to Indian nationals, according to the agency's latest annual report. Many of them work in the lower-wage, temporary category, experts say. Nearly two-thirds of the petitions approved went to workers in computer-related jobs.”

Another ridiculous visa. The people I know on them are hardly any more extraordinary than many Americans I know that are unemployed. At least in advertising - maybe it’s more useful in STEM.

You can find the salaries of your agencies H1B employees online. At my agency, they’re paid the same as everyone else.
I've hired and employed plenty of candidates on visas and I can promise you that it's about talent, not saving money by hiring internationals. The US is the center of global brands and the global ad business, and this spiteful rule just made it harder to access global talent.

Advertisers on H1B visas are not paid less. Their salaries are usually the same or even higher. They are often highly skilled and have many awards, which makes it easier for them to be re-sponsored by other agencies. Saying they are here because they are cheaper, or that they work like crazy because they only have one shot, is not accurate.
My point about US agencies hiring foreign creatives to increase creative firepower is muted in offshoring. While we benefit from them, they benefit from us. The blended work is not the same as an offshore product because if the nuances of American culture. Additionally, we lose the influence and elevation the foreign worker has on American creatives. Everyone benefits from this relationship.
