Thoughts on getting an IP specific LLM if you’re a litigator at a big firm wanting to focus on this area and even potentially move to a mid size firm focusing in this space? For context thinking soft IP not patents.

If you're a junior/ mid-level practicing attorney, you're probably better off selling your drafting/ litigation skills and experience as transferable to the world of trademark/ copyright litigation. Not sure an IP LLM would do much beyond conveying your interest in the field to potential employers. LLM programs (at least at BU, Harvard, NYU and UCLA) don't really set you up with enough knowledge to practice at the TTAB or respond to office actions (trademark prosecution). Maybe check if you could volunteer at an IP clinic or art law organization to build your experience. If you're thinking purely from a marketing/ networking perspective, I would recommend going through the TTAB blog and signing up for trademark/ copyright alerts on law 360. Good luck!

If you are anything like the litigators who get into IP without the prosecution background, you could probably use the help…

Everyone has a different perspective on this but would love to hear yours. Someone has debt ranging say 4-5% interest rates. Do you attack debt more then investing to move towards a debt free life or do you go after investments since they return historically above that then paying down closer towards retirement. I know the latter looks better on paper but what about the psychological factors of being debt free and the guaranteed return on interest savings.

Although I know you don’t need to pass the patent bar to “technically” do patent litigation, would it be a dead end move to pursue patent litigation without a technical degree / admission to the patent bar? In other words, would most BL firms refuse to staff associates on patent litigation cases if they don’t have a technical degree?
