Would patent folks out there use software that digitizes an office action? That is, the UI will link to all the cited art in the office action and will highlight cited paragraphs of the art.

This sounds useful, but I doubt how much it actually saves.

Is there tech functionality that you think would help make your job easier or do your job better?

Yes. Efficiency is becoming more important in prep and pros as fee pressure increases. Such a tool would save quite a lot of time (for attorney/paralegal/staff) when repeated for multiple office actions. You could add in links to cited sections of the MPEP as well.

With the new Patent Center, Office Actions can be downloaded in docx format. It takes me less than 5 minutes to shell a draft response. I’m not sure if it would be that helpful.

like

Even before patent center you could download docx in private PAIR

Thanks. Check out patentbutler.com.

Only kidding! Looks interesting. I’ll pass the link along to our prosecution team.

Next week I’m having my first lateral interview as a junior associate. I’m very nervous because the group with whom I’m interviewing works with life science/tech clients and the attorneys have strong science/tech backgrounds; and I do not. However, I am very, very interested in transitioning to this practice. And I reaaally want this job because it’s at my dream firm. How would you recommend preparing for the lateral interview?

I’m an AE and make a fair amount of money, but I wouldn’t mind making a few extra bucks a month. I’m a little embarrassed to pick up a side job.. does/did anyone else pick up a side job at this level?

In prosecution, if a patent attorney does not try to remove prior art cited by an examiner (eg a 130 affidavit to assert an exception under102(b)(1)(A)), but instead makes arguments to overcome the art, may the attorney made an admission that bars removing the art later in prosecution. Just received such a transfer case, looking for options.

Taking the patent bar in a week and it’s been so tough studying while working. I’m so behind in my hours this month, and my firm (midlaw, IP only) was pretty clear that they expect my hours to stay on track this month regardless of the exam. Started at said firm summer of 1L year as a law clerk/patent agent in May 2019, have worked through school and full time as associate since Sept 2021. Feeling very “stuck” in day to day work. Love the patent/IP space but drafting and pros w/minimal human interaction is getting very difficult. Thinking In House would be better, but not sure how much experience needed. Thoughts?

Bit of a niche topic: I’ve been in TS/SCI processing for a Science/Tech/Weapons analyst position with the CIA for 3 yrs since I finished grad school in chemistry, but CIA positions are sort of set it and forget it since they can take so long. I’ve since been focused on a Patent Attorney track and am with a firm that will support me taking the patent bar/law school. If I get through processing and go to the CIA for some time, do you think would I be accepted back into patent law later on?
