Not saying this is the situation, but I’ve been called by recruiters about “openings” that aren’t actually openings. They’re just using a name (for example, the recruiter has worked with the firm before or heard a few people left so they think they may hire soon) to pull in new candidates to shop around. If you have the inside track, and you don’t think they’ll let your current employer know you may be shopping around, I’d use it.

Also, many recruiters have no relationships with the firms they are pitching. I assume they just saw a job post and decide to reach out. Some cannot even answer the basic question of what’s the salary scale at the firm or who’s hiring why they are hiring

You seem to fail to understand the basic idea of this post and you are conflating it with your proffered “exclusives and retainers” as a means of justifying your career. It’s not necessary or helpful.
Unless you are the recruiter who called OP you have no idea of whether the recruiter has an exclusive relationship with the firm or wether the firm blasted the opening to a handful or even thousands of recruiters. You also don’t know what was said during the call between the recruiter or OP.
Instead you keep expressing a self serving belief that the recruiter here had an exclusive listing and that the recruiter asked OP to not reach out to the firm on their own or with another recruiter in order to shame OP and insinuate reaching out to the firm is unethical, or problematic. You have no basis for doing so other than to try and convenience people that firms/candidates need to rely on your services. We don’t.

Use your friend - the recruiter takes a substantial finders fee. You may be able to get a better signing bonus by advocating for yourself because the firm isn’t paying the recruiter.

A standard fee is 3 months of salary so yeah it’s expensive
If you go to a place that has been brought to your attention by a recruiter by going around them and essentially cheating them, they will likely tell the firm of the lack of ethics and will reflect of your loyalty. Why take the recruiter’s IP and run with it? The firms are also our clients and we work with them on almost every position in the firm. Could be awkward.

Legal executive Recruiter - Do better. In this scenario where a recruiter cold called an attorney and begun name dropping firms that the recruiter was looking to fill openings there is no indication that OP agreed to not apply to any positions discussed with the recruiter or that the recruiter even asked OP to do so. So the fact that you state that the recruiter should make an ethics complaint about the candidate to the firm is deplorable and reflects only on your self serving greed. Cold calling candidates about positions is IP? Do you even know what that stands for? So is every other recruiter who is shopping that position also stealing IP? Gtfo.
