You are likely working with the NY office and the NY office is currently very very stretched.
You're an idiot if you're working 100 hours without approval. Every freelance contract has some language in place that says work above 40 hours must be approved.
You aren’t being paid hourly so the number of hours you work is irrelevant. You have to figure out what weekly rate you need to be fairly compensated for all the work. Next time make it a much higher amount.
I worked somewhere that started doing this with freelancers and they would all sign off at 5 or take a day off if they worked 40 hours before the week was over.
It probably isn't legal. Also not legal in some states now (California, maybe others? Or is it federal law now?) to hire freelancers directly and indefinitely to do the work that is primary to the business.
Very much legal in NY - depending on the freelancer and length of assignment eventually the company has to offer some “perks” such as “paid sick leave”.
Freelancers who are on payroll are much more likely to benefit from those perks then those who contract and invoice the agency.
This also plays into freelancers who come from a staffing agency - as you know staffing agencies charge a feee for direct placements ...one way to avoid that fee is to have a freelancer from a staffing agency work for 6 months maybe more the eliminate the “finders fee”. Make sense because no one wants to be 20% on a 100k or below salary.
