There is a statute from the 70s that allows the relevant district court to appoint an acting USA if the acting USA nominated by the president is not confirmed by the Senate within 4mo or so. The NJ DCt appointed a replacement yesterday as Alina hit that deadline, and the AG promptly fired the replacement. I think the statute will likely be deemed unconstitutional if reexamined because it grants the judiciary the power to appoint executive branch personnel.
