A lot of the time I see my boss depose most/ if not all witnesses
Depends on what they saw and said happened in the incident report or traffic crash report. Most of the time no, but occasionally if we can access them and they will shed light on some fact in dispute then we will. I represent municipalities though, so by the time a claim gets to us in litigation, it’s usually not a liability question just a damages question (which is why we usually don’t depose).
Agreed. If their crash report opinion is unfavorable to my client then no. I’m not giving OC more sworn ammo. I’m gonna get the records and bills and getting the dang case settled.
If they are likely to add value, sure. Just in case they might say something useful? No. Eyewitnesses are notoriously bad. If you can describe in advance why you might call that person as a witness at trial, then do it.
