You have to convince USCIS that you fall under EB1, not just the firm! If that is possible then yes people have done it but the overseas country member firm will have to be comfortable with you coming just for a year - if you let them know your plans
From EY point of view, moving overseas means moving to different org structure and different partners. No partner will sign up for you joining them just for EB1 and then leave in a year.
Even the desi companies have stopped this practice...
I meant it as a jest! No issues. That’s my point though. The law is not just about someone getting out of the country and coming back as a EB1 candidate. It specifically defines ‘managerial’ capacity. Most EB1 C applicants are denied as they don’t fall under managerial capacity definition and a ‘manager’ title is not enough . Folks focus only on get out of country for a year and come back requirement . Granted USCIS used to grant GC easily back in the day.
I saw Deloitte people doing it. Eligible for EB 1 if you are mgr or above in India and took transfer to US.
